Kōrero Terms & Conditions

By registering as a member of our research panel entitled “Kōrero”, you agree to be bound by these terms and conditions, and it is your responsibility to read and understand them.

1. Essential information about Us

1.1 The Kōrero community, found at www.mykorero.com is run by Māori Television Service of 433 East Tamaki Road, East Tamaki, Auckland 2013, New Zealand

1.2 Membership of Kōrero is free. You may only join Kōrero once.

1.3 To join the community, you must be 16 and above years old and have a personal email address.

1.4 Participation in surveys is voluntary. By agreeing to become a Kōrero member, you agree to receive invitations to participate in surveys.

1.5 You may unsubscribe from Kōrero membership at any time. If you no longer wish to receive emails about Kōrero, you may opt-out from using the Kōrero (including, without limitation, from receiving newsletters or communications), at any time, by: (i) following the unsubscribe procedures described on Kōrero platform; or (ii) (ii) by sending an email to korero@maoritelevision.com. We will use reasonable efforts to read and respond to each email request within a reasonable period of time after receipt.

2. Data Protection and Privacy

2.1 By registering to Kōrero, signing up and participating in our research activities or providing information to us or Yabble Limited, you acknowledge you have received notice of Kōrero Privacy Policy and consent to the collection and use of your information by us and contractors in accordance with this policy

3. Communication

3.1 You can contact us by email at korero@maoritelevision.com. We will use the email address you have provided to us to contact you.

4. Using Kōrero

4.1 You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use this website content in any way except for your own personal, non-commercial use. You also agree not to adapt, alter or create a derivative work from any of Kōrero content except for your own personal, non-commercial use. Any other use of this website content requires our prior written permission.

4.2 You agree to use Kōrero only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of this website.

4.3 You undertake that all information you give in relation to Kōrero will be as accurate as possible, and understand and accept that providing false or misleading information could lead to being disqualified from Kōrero.

5. Disclaimers and Limitation of Liability

5.1 The content of Kōrero, including the information, names, images, pictures, logos and icons regarding or relating to us, its products and services, is provided "AS IS" and on an "IS AVAILABLE" basis without any representations or any kind of warranty made (whether express or implied by law) to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

5.2 Under no circumstances we will be liable for any of the following losses or damage (whether such losses are foreseen, foreseeable, known or otherwise):

(a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of this website regardless of the form of action.

5.3 We do not warrant that functions contained in Kōrero will be uninterrupted or error free, that defects will be corrected, or that this website or the server that makes it available are free of viruses or bugs.

6. Intellectual Property

6.1 The names, images and logos identifying us are subject to our copyright, design rights and trademarks. Nothing contained in these terms shall be construed as conferring any licence or right to use any of our trademarks, patents, design rights or copyrights.

7. Contributions to Kōrero

7.1 Where you are invited to submit any contribution to Kōrero (including any text, photographs, graphics, video or audio), you agree, by submitting your contribution, to grant us a perpetual, royalty-free, non-exclusive, sub-licensable right and license to use, reproduce, adapt, publish, translate, create derivative works from, distribute, perform, play, make available to the public, and exercise all copyright and publicity rights with respect to your contribution worldwide and/or to incorporate your contribution in other works in any media now known or later developed for the full term of any rights that may exist in your contribution. If you do not want to grant to us the rights set out above, please do not submit your contribution to Kōrero.

7.2 Further to paragraph 7.1, by submitting your contribution to Kōrero, you warrant that your contribution: is your own original work and that you have the right to make it available to us for all the purposes specified above; is not defamatory; and does not infringe any law. You indemnify us against all legal fees, damages and other expenses that may be incurred by us as a result of your breach of this warranty, and waive any moral rights in your contribution for the purposes of its submission to and publication on this website and the purposes specified above.

7.3 You agree not to use Kōrero in any way that is illegal or causes damage or harm to us or others. This includes (but is not limited to):

sending unsolicited electronic mail to any person for the purpose of advertising or promoting any organisation (spamming);
infringing our, or any other party's, intellectual property rights, including by distributing copyright material;
using or distributing the personal information of others in any way without their consent;
using the website in any way that is offensive to others, including using inappropriate language or expressions of bigotry or hatred;
engaging in harassment, whether through language, frequency, or size of messages
attempting to gain unauthorised access to any system, network or account belonging to us or another person (hacking);
attempting to intercept, interfere with or deny the website to any another person;
introducing or sending anything harmful or destructive (such as DDOs attacks, viruses, worms, Trojan Horses, time bombs or bots) to our or anyone else's computer system or communications services;
engaging in any fraudulent activity, such as the use of a false identity, hiding the source of the message, or making the source appear to be someone else; and
using the website in any way that encourages another person to breach the prohibitions covered under these Terms of use.

7.4 If we feel that you have breached these terms and conditions, we may immediately suspend or terminate your membership of the Kōrero community, without any notice or liability to you.

8. Market research activities within Kōrero

8.1 The answers you give us will be treated as confidential unless you have given your consent to the contrary. We will not send you unsolicited mail or pass on your e-mail address to others for this purpose.

8.2 As with all forms of marketing and opinion research, your cooperation is voluntary at all times. No personal information is sought from or about you, without your prior knowledge and agreement.

8.3 If you no longer wish to receive emails from Māori Television and Yabble about the Kōrero community, please "unsubscribe" by emailing korero@maoritelevision.com.

9. Security Techniques

9.1 We use cookies and other similar devices sparingly and only for quality control, validation and to prevent bothersome repeat surveying. You can configure your browser to notify you when cookies are being placed on your computer. You can also delete cookies by adjusting your browser settings.

9.2 Kōrero has security measures in place to protect the loss, misuse, and alteration of the information under our control.

10. Changes to and termination of Kōrero

10.1 We may make changes to the Kōrero website. In the event we deem a change, at our sole discretion, requires you to be notified, we will notify you by sending an email to the email address you provided.

10.2 If you do not participate in any surveys after 12 months we may terminate your membership of the Kōrero community.

11. Prize draws

11.1 As a member of Kōrero you may be entered into regular prize draws for participating in the community forums and completing surveys. We reserve the right to open, suspend or terminate such draws at any time without prior notice. For each draw, we will state the conditions of entry, prize available, dates competition is available for and date the prize will be drawn.

11.2. We reserve the right to update the terms and conditions of any prize draws from time to time by posting an updated version on the Kōrero website. Your continued use of the Kōrero website or participation in surveys and/or price draws after we post any such changes indicates your acceptance of those changes

Whakaata Māori Whānau Gym Membership Joining Promotion Terms and Conditions

These terms and conditions relate to the giveaway promotion provisionally called “Whānau Gym Membership Promotion” (“Promotion”). Information on how to enter and prizes forms part of, and entry into the Promotion is deemed to be acceptance of these terms and conditions.
The Promotion aims to encourage audiences to join the Kōrero research panel.
By participating in the Promotion and by accepting any prize, you, the entrant, agree to be bound by these Terms and Conditions and the Promoter’s Terms of Access available at https://www.maoritelevision.com/terms-access.
The promoter is Whakaata Māori (“Promoter”), acting through Whakaata Māori Channel, Te Reo Channel (“Whakaata Māori Channels”), the Whakaata Māori official social media accounts including but not limited to https://www.facebook.com/maoritv.nz/ Facebook account, https://www.instagram.com/maoritelevision/ Instagram account, and https://www.linkedin.com/company/maoritelevision/ LinkedIn account (“Social Media Accounts”), and any social media accounts of those acting in affiliation with Māori Television Service.
The Promotion commences on 14 January 2023 at 00:00 and closes at 23:59 on 1 March 2023 (“Promotional Period”). Entries received outside of the Promotional Period will not be accepted.
Employees and independent contractors (and each of their immediate family members) of the Promoter, its retailers, suppliers, associated companies and agencies are not eligible to enter. Employees and independent contractors of the Government, crown agencies and/or crown entities must adhere to gift and ethics policies applicable to them when entering the Promotion or accepting any prize.
Any resident or citizen of New Zealand who is eligible to join the research panel can participate in the Promotion during the Promotional Period. If an entrant is under 18, the Promoter may require that entrant’s parent or guardian to agree to these terms, give consent to the entrant for participating in the Promotion and to claim a prize if such entrant is one of the winners.
To participate you are required to:

Validly complete and submit the join up survey on mykorero.com.

The details provided on the join up survey must be those of a real person, using a real identity. Entries that breach this clause will be disqualified.
The Promoter will randomly draw 1 winner from all eligible entries received during the Promotional Period. The winner will be contacted by email.
The Prize for the Promotion is for a Gym Membership for Whānau, chosen by the winner up to the value of $2500 for annual memberships.
The Promoter may announce the winner on Whakaata Māori Channels, or on the MyKōrero website. The Promoter will send an email to the winner requesting their consent to use their name, image or likeness in its public announcements of the winners of the Promotion.
The Promoter reserves the right to request the winner to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity. In the event that such proof is not provided by the winner or is not suitable to the Promoter, then the winner will be deemed to have forfeited their rights to the prize.
The winner must respond to the relevant message within 5 days, and provide the Promoter with complete and accurate information. If they fail to respond and provide the Promoter with complete and accurate information within 5 days they will be disqualified, and a new winner will be drawn.
The Promoter will courier the prize to the winner. The Prize becomes the winner’s responsibility once the Promoter hands it to the courier and accepts no responsibility should the prize be damaged or lost during transport.
By participating in the Promotion, you will be providing your information to the Promoter and Yabble Limited. Though the promotion may be advertised on social media, it is in no way sponsored, endorsed, or administered by any third party social media platform. You completely release any third party social media platform from any and all liability in connection with this Promotion.
All entries become the property of the Promoter. By participating in the Promotion, you are transferring all rights, title and interest (if any) vested in your entry to the Promoter, including, without limitation, copyright, format rights, reputation rights and all ancillary rights, in the results and proceeds of its activities and/or third party producer’s services in all media throughout the world for all purposes for the full period of copyright and all renewals thereafter.
The Prize is not transferable and/or exchangeable.
The winners may not designate someone else as a winner. If you are unable or unwilling to accept your prize, the Promoter may award it to an alternate winner.
If you accept a prize, you will be solely responsible for all applicable taxes (except withholding tax which will be paid by the Promoter), levies, insurances, expenses including but not limited to meals and transport, and any other fees and costs related to accepting the prize.
The winners permit having their name, image and likeness appear in connection with the Promotion, the Promoter or the advertising or marketing thereof, in any media whatsoever throughout the world.
To the fullest extent permitted by law, the Promoter, its suppliers, associated companies and agencies will not be liable to you for any direct, indirect or consequential loss or damage whatsoever, including personal injury, which is suffered as a result of, or arising from, your participation in the Promotion or winning (or not winning) any prize.
Subject to any applicable law which cannot be excluded, the Promoter and their employees are not responsible for any loss or damage whatsoever that is suffered (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained during the course of participating in the Promotion and/or accepting and/or using the prize.
The Promoter reserves the right, at any time, to verify the validity of any entry and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry and/or selection process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Errors and omissions will be accepted at the Promoter’s discretion.
The Promoter’s decision in relation to the winners, or any other aspect of this Promotion, is final and no correspondence will be entered into.
The Promoter may modify these terms and conditions at any time without notice. The Promoter reserves the right to cancel, suspend or change the Promotion or any element of the Promotion for any reason, including any cancellation, suspension or change necessitated by any event outside of The Promoter’s control.
You are responsible for all content submitted as part of your entry. The Promoter shall not be liable in any way for such content including but not limited to those arising out of the persons involved with the entries to the full extent permitted by law. The Promoter may remove any content from the Promotion from its social media accounts without notice, for any reason whatsoever. You warrant and agree that: (a) you will not submit any content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, or otherwise unsuitable for publication; (b) you will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.
No responsibility is accepted by the Promoter for entries that are late, misdirected, incomplete, illegible, or lost, incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access telecommunications network services, or any other error or malfunction whatsoever, and is in no way liable for any entries not lodged, or incorrectly lodged, in the Promotion database.
All entries and their records become and remain the sole property of the Promoter. Unless otherwise advised by you, all entries will be entered into a database and the Promoter reserves the right to use your personal information for marketing purposes.
The Promoter, in its sole discretion, reserves the right to cancel, suspend, terminate or modify the Promotion if fraud, technical failures or any other factor beyond the Promoter’s reasonable control adversely affects the Promoter’s ability to conduct the Promotion as contemplated in these terms and conditions, subject to any written directions from any regulatory authority. Any cancellation or modification to the Promotion will be notified on the MyKōrero website.
The personal information you provide to the Promoter will be stored at the Promoter’s systems and used for the purposes expressed under these Terms and Conditions.
You have the right to access and correct or ask for deletion of your personal information by contacting the Promoter in writing by sending an email to kōrero@maoritelevision.com

Introduction

Māori Television Service (“we”, “us”, “our”) takes your privacy very seriously and complies with the Privacy Act 2020 (the Act) when dealing with personal information. Personal information is information about an identifiable individual (a natural person).

This policy sets out how we will collect, use, disclose and protect your personal information for the purpose of conducting market research on our business directly or through our research platform and technology provider Yabble Limited.

By registering to Kōrero, signing up and participating in our research activities or providing information to us or Yabble Limited, you acknowledge you have received notice of this policy and consent to the collection and use of your information by us and contractors in accordance with this policy.

This policy does not limit or exclude any of your rights under the Act. If you wish to seek further information on the Act, see www.privacy.org.nz.

Yabble Limited and its services have their own privacy policies which are independent of ours. We may change this policy from time to time. In the event of a change, we will notify you through sending an email to the email address you provided us with and the change will apply from the date of such notification.

Why do we collect your personal information

We collect your personal information to conduct market research to better understand how New Zealanders perceive our service and how we can innovate and improve based on your feedback. We aim our research to represent a wide range of ages, genders, ethnicities and regions of residency across New Zealand.

Who do we collect your personal information from

We collect your personal information: directly from you, when you provide or you have provided your personal information to us, including via our website www.maoritelevision.com and any related service, through any registration or subscription process, through any contact with us (e.g. telephone call or email), through our previous market research activities you participated in, including without limitation surveys or otherwise, or when you used our services and products by any means;

third parties such as, without limitation, Yabble Limited, and our other market research technology partners and platform providers, where you have authorised the collection and use of your personal information.

How we use your personal information

We will use your personal information:

to verify your identity;
to contact you;
to register you as a participant in our market research and audience database;
to inform you of the research projects we conduct and invite you to participate in surveys and other research activities as applicable, including contacting you electronically (e.g. by text or email for this purpose);
to make sure our research and results are representative across ages, genders, regions of residence and ethnicities in New Zealand;
to conduct any other research and statistical analysis (on an anonymised basis);
to improve the quality of our research activities and our services in general;
to protect and/or enforce our legal rights and interests;
to fulfil our legal duties of disclosure if we receive an Official Information Act request, judicial or other government subpoena, warrant or order;
for any other purpose authorised by you or the Act.

Our selected employees with a need-to-know and Yabble Limited are the only people who can access your personal information for the purposes set out in this policy.

Your survey answers will remain anonymous and only be reported in an aggregated form with answers from other respondents. Your answers or personal information will remain anonymised and will not be disclosed.

However, when you are participating in a discussion (as opposed to a survey) your chosen display name and comment/s will be visible to all others participating in the discussion.

We will treat all your research panel and survey-related communications (excluding personal information) with us or Yabble Limited and the content submitted or transmitted by you to the research panel provided by Yabble Limited by digital upload to the platform and/or website, electronic mail or otherwise, as non-confidential and non-proprietary information, unless specifically indicated by you either prior to, or contemporaneously with, the submission or transmission of such communications and content.

Your telephone calls and e-mails to us may be recorded and monitored for quality control purposes.

Disclosing your personal information

We may disclose your personal information to:

Yabble Limited;
any business that supports our services and products, including any person that hosts or maintains any underlying IT infrastructure and system or data centre that we use to provide our services and products
other third parties (for anonymised statistical information)
a person who can require us to supply your personal information (e.g. a regulatory authority)
any other person authorised by the Act or another law (e.g. a law enforcement agency)
any other person authorised by you.

Protecting your personal information

We will take reasonable steps to keep your personal information safe from loss, unauthorised activity, or other misuse. Your personal information is stored securely by us and our technology provider, Yabble Limited.

Accessing, correcting and removing your personal information

Subject to certain grounds for refusal set out in the Act, you have the right to access your readily retrievable personal information that we hold and to request a correction to your personal information. Before you exercise this right, we will need evidence to confirm that you are the individual to whom the personal information relates.

Each year, you will receive an email from us or Yabble Limited, encouraging you to check whether your profile information is still accurate and up to date. In other cases, if you request a correction, if we think the correction is reasonable and we are reasonably able to change the personal information, we will make the correction. If we do not make the correction, we will take reasonable steps to note on the personal information that you requested the correction.

You have the right to opt-out of any research activity at any time. If you opt-out, your personal information will be removed from the applicable participants list. However, we will retain your personal information, answers and any other historical you have provided to us or Yabble Limited in previous research activities, unless you expressly request otherwise.

If you request yourself to be removed entirely from our database and research activities, we will respond to you with an estimate timeframe during which we will safely delete your personal from our systems
